Case Update (22 March 2022): Golan v. Saada; Live Oral Arguments

Case Update (22 March 2022): Golan v. Saada; Live Oral Arguments

March 22, 2022

The U.S. Supreme Court will hear oral arguments in its fifth Hague Abduction Convention case today, March 22, 2022. Interested individuals can hear audio of the arguments live on the Supreme Court’s website. You can also follow ScotusBlog’s live tweets here.

The question that Ms. Golan presented to the Court is: “Whether, upon finding that return to the country of habitual residence places a child at grave risk, a district court is required to consider ameliorative measures that would facilitate the return of the child notwithstanding the grave risk finding.”

Interested individuals can find all the briefs that have been filed in this case on the Supreme Court’s docket here. The argument will start at 10 a.m. Eastern Time. Counsel for Petitioner will have 20 minutes, followed by the U.S. Solicitor General for 15 minutes, and Counsel for Respondent for 35 minutes.

Since the docket is quite long, the key briefs are:

Petitioner’s Brief

The United States’ Brief

Respondent’s Brief
